Decree-Law No. 34/2015 of 4th March transposes into national law Directive 2012/35/EU of the European Parliament and of the Council of 21st November 2012, amending the Directive 2008/106/EC of the European Parliament and of the Council of 19th November 2008, on the minimum level of training of seafarers and regulates the implementation of the Manila´s Amendments to the Annex to the International Convention on Standards of Training, Certification and Watch Keeping for Seafarers, 1978.

Decree-Law No. 280/2001 of 23rd October, as amended by Decree-Law No. 206/2005 of 28th November, and by Decree-Law No. 226/2007 of 31st May, establishes the rules governing the seafarers´ professional activity, including those relating to: their maritime registration and the issue of seaman´s registration books; their physical fitness, classification, categories and access requirements and duties to be performed; training, certification, recognition of certificates, recruitment and boarding and disembarkation regimes and safety of people in the vessels (in matters not abolished by Decree-Law No. 34/2015 of 4th March).

Law No. 146/2015 of 9th September regulates the seafarers´ activity on board vessels flying Portuguese flag, as well as the responsibilities of the Portuguese State as flag State or port State, in order to comply with mandatory provisions of the Maritime Labour Convention, 2006, of the International Labour Organization.

Notice No. 118/2016 of 12th December makes public that, on 12th May of 2016, the Portuguese Republic deposited with the Director-General of the International Labour Office, as depositary, its instrument of ratification of the 2006 Maritime Labour Convention (2006 MLC), adopted by the General Conference of the International Labour Organization at its 94th session, held in Geneva on 23/2, 2006.

Ordinance No. 293/2013 of 14th May establishes that, until the final designation of the entities competent for the purposes provided in the 2006 MLC, the General-Directorate for Natural Resources, Safety and Maritime Services is entrusted with the performance of the tasks arising of the responsibilities of Portugal as a flag State in relation to the matters referred to in that Convention.

Law No. 102/2009 of 10/9 regulates the legal framework for the promotion and prevention of occupational safety and health at work, in accordance with the provisions of article 284 of the Labour Code, regarding the prevention. It also regulates the protection of minors in the case of works that, due to its nature or the conditions under which they are performed, are detrimental to their physical, psychological and moral development, in accordance with Article 72 of the Labour Code.
